OVERVIEW Welcome to LUMÉRI! The terms "we", "us" and "our" refer to LUMÉRI. LUMÉRI operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience for jewelry and clothing (the "Services"). LUMÉRI is powered by Shopify, which enables us to provide the Services to you.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You are solely responsible for maintaining the security of your account credentials and for all of your account activity.

SECTION 2 - OUR PRODUCTS (JEWELRY & CLOTHING)

We have made every effort to provide an accurate representation of the colors, textures, and details of our jewelry and clothing. However:

• Color Accuracy: Colors may differ based on your device settings and screen configuration.
• Unique Characteristics: Many of our jewelry pieces and garments may feature natural stones or unique fabrics. We do not warrant that the item received will be an exact 1:1 replica of the digital render, as natural variations are a mark of authenticity in fine materials.
• Availability: We reserve the right to limit the quantities of any products (particularly limited-edition collections) or discontinue items at any time without notice.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. LUMÉRI reserves the right to accept or decline your order. Your order is not accepted until we confirm acceptance and process payment. Please review your order carefully; due to the high-value nature of our jewelry and clothing, we may be unable to accommodate cancellation requests once processing has begun. Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

SECTION 4 - PRICES AND BILLING

Prices for our jewelry and clothing are subject to change without notice. Posted prices do not include taxes, shipping, customs, or import charges unless stated. You represent that you are authorized to use the payment method provided and that all billing information is accurate.

SECTION 5 - SHIPPING AND DELIVERY

We currently ship to the European Union and the United States. We are not liable for shipping delays caused by carriers or customs. Once we transfer products to the carrier, title and risk of loss passes to you. For high-value jewelry shipments, we recommend ensuring your delivery address is secure.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, Luméri brand names, jewelry designs, clothing patterns, images, and text, are owned by LUMÉRI and are protected by copyright and intellectual property laws. You may use the Services for personal, non-commercial use only. You must not reproduce or "copy" our designs without our prior written consent.

SECTION 7 - OPTIONAL TOOLS & SECTION 8 - THIRD-PARTY LINKS

We may provide access to third-party tools (like size guides or currency converters) and links to external sites. Use of these is at your own risk. We are not liable for any harm related to third-party resources.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

LUMÉRI is powered by Shopify. You acknowledge that Shopify is not responsible for any aspect of the sales between you and LUMÉRI. You release Shopify from all liabilities arising from your transactions with us.

SECTION 10 - PRIVACY POLICY

Your submission of personal information through the store is governed by our Privacy Policy. By using the Services, you acknowledge how your data is handled by both LUMÉRI and Shopify.

SECTION 11 - FEEDBACK

If you send us reviews or suggestions ("Feedback"), you grant us a perpetual license to use and display that content (e.g., featuring your review on our website). We reserve the right to remove feedback we deem offensive or unlawful.

SECTION 12 - ERRORS AND OMISSIONS

Occasionally, there may be typographical errors regarding jewelry specifications or clothing sizing. We reserve the right to correct these and cancel orders if information was inaccurate at the time of purchase.

SECTION 13 - PROHIBITED USES & SECTION 14 - AGENTS

You may not use our site for unlawful purposes, to infringe on our IP, or to deploy automated "agents" or bots to scrape our designs or inventory data.

SECTION 15 THROUGH SECTION 24 - LEGAL STANDARDS

These sections cover our right to terminate service, our Disclaimer of Warranties (Services provided "As Is"), Limitation of Liability, and Indemnification.

These Terms are governed by the laws of the Federal Republic of Germany, with jurisdiction in Köln, Germany, regardless of conflict of law principles.

US Customers: By using our Services, customers located in the United States agree that any disputes arising from these Terms or their purchases shall be governed by German law and resolved exclusively in the courts of Köln, Germany. To the extent permitted by applicable law, you waive any objection to this jurisdiction.
